TERMS AND CONDITIONS OF THE SHOP

 

I.    DEFINITIONS

 

Where mention is made of:

the “Seller” – it should be understood as the Association of Authors and Publishers of Scientific Papers „UNIVERSITAS” seated in Kraków (31-016), at 17 Sławkowska Street, entered into the Register of Enterpreneurs kept by the District Court for Kraków Śródmieście in Kraków, 11th Commercial Division of the National Court, under number 0000058323, NIP number 676-001-61-68 and REGON number 350269030.


“Goods” –  they should be understood as the goods presented on the website and offered for sale by the Seller.

 

“E-books” – they should be understood as electronic books. Books can be available as PDF, MOBI or EPUB files. 

“User” – should be understood as a natural person having full capacity for acts in law and natural person or entity capable of acquiring rights and undertaking obligations in its own name, purchasing Goods in the shop for the purposes other than reselling them in the course of their business activities.

 “Order” – should be understood as a proposal to conclude the contract made by the User to the Seller by means of the online form or via telephone + 48 12 413 91 36.  

“Data” – should be understood as the data provided by the User when placing the Order, needed for the execution of the Order such as the name, surname, e-mail address, telephone number, place of residence and delivery address.

“Contract” – should be understood as the distance contract for the sale of goods concluded by electronic means provided at the website, between the Seller and the User, whose object is to establish the terms and conditions of selling the Goods to the User.

“Website” – should be understood as the one at www.universitas.com.pl.

“Shop” – should be understood as the online bookshop run by the Seller on the website.

“The Terms and Conditions” – should be understood as these terms and conditions.

II. TECHNICAL CONDITIONS TO USE THE SHOP

1.    The following technical conditions are needed for the User to use the Shop:
    – display resolution: 1024x768 or higher,
    – colour depth 32 bits or higher
    – browsers: Internet Explorer 8 or higher, Google Chrome, FireFox, Opera, Safari,
    – enabled cookies,
    – enabled Javascript.

2.    The Seller stipulates that unless the above presented conditions are met he will not be able to allow the User to place the order via the Website, nor conclude the contract and execute it.

III. PLACING AN ORDER

 

1. The Users may place the orders:

– at www.universitas.com.pl - 7 days a week and 24/7

– by sending an e-mail to: ksiegarnia@universitas.com.pl

– via phone by calling +48 12 4139136, Monday-Friday 8:00-16:00.

– by sending a letter to: Universitas, Sales Department, ul. Żmujdzka 6B, 31-426 Kraków

- in person, at the Sales Department of Universitas located at ul. Żmujdzka 6B, 31-426 Kraków

 

2. Each presented product is accompanied by the picture. By clicking the picture the User will see the details (essential characteristics of the product), its price, table of contents etc.

 

3. The User adds a chosen book to the order by clicking basket icon or “BOOK” / “E-BOOK”.

 

4. The User can modify his or her order in the basket by changing the quantities of the products, i.e.:

– increasing/limiting the number of paper copies of the book,

– removing the product from the basket.

 

5. In the basket the User can enter the discount voucher and confirm it by clicking “CONFIRM”. If the discount voucher is valid the value of Order in the basket will be recalculated.

 

6. Clicking “NEXT” the User confirms the list of the products and proceeds to the next step of order placement.

 

7. When proceeding the User has an obligation to:

- choose delivery option

- choose payment option

- provide the Seller with the address for the delivery

- if invoice option selected - provide billing data for VAT invoice

- accept “Information to be accepted”

 

The User has an option to add additional comments in the designated field (adding comments may affect the delivery time).

 

8. Clicking “NEXT” the User confirms the Data entered and proceeds to the next step of order placement.

 

9. The User verifies all the data provided in the Order in the order summary.

 

10. If the User has entered incorrect Data or wishes to modify/stop the order he or she can go back to previous steps by clicking “Back”. This option is available at any stage of Order placement.

 

11. Clicking “NEXT” the User confirms the information about the Order, places the order and goes to the payment site.

 

12. Placement of the order will be confirmed by the e-mail sent to the user’s address given by him or her in the form or by phone.

 

13. Before accepting the Order the Seller can contact the User for example to dispel any doubts, clarify the details of the Order or inform the User about the lack of Goods. In justified cases, particularly in case of doubt concerning the accuracy of the data provided by the User, the Seller reserves the right to refuse to execute the Order.

 

14. The Order shall be executed unless the Goods in the Order are not available. If the Goods ordered are not available, the Seller shall notify the User not later than in 3 (three) days and shall return the money. The notification shall be sent to the address given by the User by phone or in the order form.

 

15. If the Goods ordered are not available, the Seller shall notify the User about the fact and the need to modify the Order not later than in 3 (three) days. The User shall without undue delay indicate a way to modify the Order by deciding upon partial delivery, extending the delivery time, replacing the Goods or cancelling the Order.

 

16. Only limited quantities of Goods are intended for promotions and sales. The Orders are executed in order of their placement until stocks are exhausted.

 

17. The contract is concluded when the User receives the information about the acceptance of the order for completion to the e-mail address provided by the User.

 

18. If the Order has errors or needs to be modified the User should contact the Seller by phone or e-mail.


IV. PAYMENT TERMS

1. All prices are in PLN and include VAT. The price next to the Goods at the moment of order placement shall be binding.

2. The Seller reserves the right to change prices of the Goods presented on the website. The changes do not apply to Orders that had bee placed before the price was changed.

3. The User can pay for the ordered Goods:  
    – upon the receipt of the delivery (cash on delivery);
    – by money transfer into indicated bank account (the number shall be provided to the User by e-mail together with Order confirmation);

    – Visa, MasterCard, Siners Club or JBC (System Polcard)

    – by PayU.pl

    - in cash or by card upon pick-up in person at the Seller's Sales Department at ul. Żmujdzka 6b in Krakow (entrance into the yard)

 

4. The Users being the consumers as defined by the Civil Code may withhold the payment until they receive the Goods.

 

5. Together with the delivery of Goods the User shall receive Vat invoice. The User making the purchase agrees to issuing sales document without signature. 

V. DELIVERY TIME 

1. The Order shall be processed and ready for dispatch within 2 business days from the day when the Order was placed.

2. The Seller will send the ordered Goods by Polish Post (Poczta Polska), courier (Pocztex, DPD) or to the InPost parcel pick-up stations as chosen by the User.

VI.  E-BOOK SALE TERMS

1. The Order including E-books shall be transferred for processing when the Seller receives the information about successful payment.

2. In case the Order includes both e-books and goods of other type, it will be divided into e-book(s) Order and other type Order.

3. Upon the receipt of the information about successful payment the Seller shall send the User information by e-mail containing: (a) notification about the receipt of payment, (b) information on how to download the e-book.

4. The User has the right to cancel the Order until the e-book is downloaded from the shop. If the Order is cancelled the Seller shall refund the amount paid.

5. E-books which have been purchased and paid for shall be available for download by the Client in the "My files" section after logging in to "My account" on the website www.universitas.com.pl

6. Information about the scope of the license, such as the number of devices on which the e-book can be opened, may be placed on the shop’s website. In the absence of such information it is considered that the E-book can be used exclusively in the extent of permitted personal use according to the Act on Copyright and Related Rights of 4 February 1994.

7. Where E-books are sold, the invoice referred to in IV (5) of the Terms and Conditions shall be sent to the User by e-mail.

VII. THE RIGHT OF WITHDRAWAL

1. Under the Act on consumers’ rights of 20 May 2014 (Journal of Laws of 24 June 2014) the Users purchasing the Goods as consumers as defined in the Article 221 of the Civil Code are entitled to withdraw from the Contract (cancel the purchase) within 14 days from the date the Goods were collected.

2. To withdraw from the Contract the User must send to the Seller’s address indicated in 1 above or to deliver to the Seller’s point of sales a relevant declaration together with Goods cancelled and the receipt/VAT invoice. The Seller shall not bear the costs of returning the Goods, hence does not accept the cash upon deliveries. The Goods must be returned in the unaltered state. 3. In the case of valid withdrawal according to the provisions specified above the Seller shall refund to the User the amount paid for the Goods, if the payment was made in advance, and shall certify in writing the return of the Goods.

VIII.    PERSONAL DATA

1. Data are administered by the Seller. Data shall be processed for the purpose of executing the Order. The User has the right to access and modify the Data. Data are collected on a voluntary basis, however failure to provide the Data prevents placing the Order and concluding the Contract.

2.  The data are protected according to applicable laws and with the use of the best technological measures, for instance the server with the software is placed in a dedicated, secured and monitored room and Data are processed by means of a modern software which prevents any unauthorized access.

3. The Orders cannot be placed anonymously.

IX.    COMPLAINTS, INCLUDING E-BOOKS.

1.    The User has the right to make a complaint in case of damaged Goods in any form: paper, storage device (CD, DVD, flash memory) or e-book (epub, mobi, PDF).

2.    The complaint in writing should be sent to the Seller’s address: ul. Żmujdzka 6b, 31-426 Kraków together with the faulty Goods and justification in writing (e.g. the lack of pages, non-printed pages or non-displaying pages in case of e-books, transportation damage, and specification of the device on which the E-book is read).

3.    The complaints shall be considered within 14 days from the date of the receipt of faulty Goods by the Seller. The Seller shall notify the User about the outcome of the complaint the same way the complaint has been delivered unless the User reserves otherwise.

4.    If the Data or information provided in the complaint are incomplete the Seller shall contact the User who is placing the complaint and ask him or her to supplement them in the indicated scope prior to the consideration of the complaint.

X.    FINAL PROVISIONS

1. These Terms and Conditions are effective from May 1, 2024.

2. By ordering Goods the User accepts these Terms and Conditions. Notwithstanding the above, placing the Order requires thorough reading of the Terms and Conditions and checking the appropriate field in the form confirming that the User has read the Terms and Conditions and accepts them in full.

3.  The Seller reserves the right to change the Terms and Conditions. Any changes in the Terms and Conditions shall be effective in 7 days from being published on the website. Any Orders placed before the changes were made are executed on the basis of provisions effective for the date of placing the Order.

4. If any of the provisions of these Terms and Conditions is modified or cancelled by the decision of a competent court, the remaining provisions shall remain in force and shall be binding on the Seller and User.

5. Polish law shall govern any disputes relating to the Terms and Conditions. These disputes shall be settled by a court of law with local jurisdiction.
